Terms of Use

 

This document (the “Agreement”) contains all of the terms and conditions between Kickir Club and the individual player, herein referred to as the “Client”.

“Client” is defined as a person who has created a new Kickir Club account. Kickir Club may modify any of the terms and conditions contained in this Agreement, at any time and at in its sole discretion, by notifying the Client via email, or by posting a notice or a new agreement on its website. Modifications may include, but are not limited to, changes in the scope of available game types, schedules, banking center options, limits and procedures or referral program rules. If any modification is unacceptable to the Client, they may terminate this Agreement and close their account. Client’s continued activity following Kickir Club’s posting of a change notice or new agreement on Kickir Club’s website will constitute binding acceptance of that change.

 

1. Signing Up – JOIN

A Client may begin the sign-up process by submitting a complete application of the sign-up page on the Kickir Club website. It is required that the information provided by the Client at the time of signup be accurate and valid. Kickir Club reserves the right to reject or cancel any account created if it has been determined that the Client has already created an account, that the information is invalid or inaccurate, has been blacklisted, or for any other reason left to the sole discretion of Kickir Club.

By opening an account with Kickir Club, the Client consents and agrees to all Kickir Club rules, policies and operating procedures. Kickir Club reserves the right to refuse Client’s action or close its account if necessary to comply with any external or internal requirements that may be established. Clients shall not open more than one Client account per household without prior written consent from Kickir Club. In the event of a violation, Kickir Club has the right to void all current and future play as well as the potential win/loss from that play.

 

2. Choice/Opt-out

Kickir Club communicates with Clients on a regular basis to provide information regarding Client’s account, exclusive offers and updates. Kickir Club may contact its Clients via email, in accordance with their expressed wishes. Kickir Club respects Client privacy and will not rent, trade or release Client information without their consent, or as agreed to by Client. 

 

3. Reporting Activity

Kickir Club will keep periodic track of Clients’ gameplay activity at all times and will supply reports summarizing this activity. The format, content and frequency of the reports may vary from time to time in Kickir Club’s sole discretion.

 

4. Player Rights

The Client reserves the right to question or request clarification of rules, policies, and procedures implemented by Kickir Club. Questions should be directed to an Account Management representative through Kickir Club’s support email. In the event there may be a discrepancy with a game or an account balance, the Client may request a report of their gameplay activity at any time.

 

5. Terms & Termination

The term of this Agreement will begin upon Kickir Club’s written confirmation of the creation of Client’s account. Either Kickir Club or the Client may terminate this Agreement at any time, with or without cause. Kickir Club has the right to terminate the Agreement without prior notice if the Client breaches any term or condition of this Agreement.

Kickir Club may withhold final payment for a reasonable time to ensure that the correct amount is paid to the Client.

 

6. No Representation or Guarantee Regarding Profits or Income

The Client agrees, understands and acknowledges that Kickir Club’s officers, directors, shareholders, employees, and/or accountants have made no representation of any nature whatsoever to the Client regarding profits, income, or money which the Client may obtain or generate from the Service; and/or from entering into this “Agreement”; and/or from marketing; and/or promoting any version of this Service; and/or from any other matter relating to this “Agreement”; and/or to the subject matter of this “Agreement.”

Any expression by Kickir Club in this regard is an expression of opinion only and the Client agrees, understands, and acknowledges that they have not been induced to, and/or persuaded thereby to, enter into this “Agreement” and that the Client has entered into the Agreement of their own free will and choice, without any force or duress, and only after thorough, complete, full, and thoughtful investigation and after obtaining independent advice and counsel from their accountant, their attorney, and their financial advisors.

 

7. Disclaimers

Kickir Club makes no express or implied warranties or representations with respect to its services. In addition, Kickir Club makes no representation that the operation of its site will be uninterrupted or error-free and will not be liable for the consequences of any interruptions or errors.

 

9. Limitation of Liability

Kickir Club will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement, even if Kickir Club has been advised of the possibility of such damages. Further, Kickir Club’s aggregate liability arising with respect to this Agreement will not exceed the total commission fees paid by, or payable to, Client under this Agreement. Nothing in this Agreement shall be construed to provide any rights, remedies, or benefits to any person or entity not a party to this Agreement. Kickir Club’s obligations under this Agreement do not constitute the personal obligations of its directors, officers, employees, or shareholders.

 

10. Independent Investigation

The Client acknowledges that he/she has read this Agreement and agrees to all its terms and conditions. The Client has independently evaluated the desirability of participating in this Agreement and is not relying on any representation, guarantee, or statement other than set forth in this Agreement.

 

11. Assignability and Inurement

The Client may not assign this Agreement, by operation of law or otherwise, without the prior written consent of Kickir Club. Subject to that restriction, this Agreement will only be binding on, inure to the benefit of, and enforceable against the Client and Kickir Club.

 

12. Non-Waiver

Kickir Club’s failure to enforce Client’s strict performance of any provision of this Agreement will not constitute a waiver of its right to subsequently enforce such provision or any other provision of this Agreement. NO MODIFICATIONS, ADDITIONS, DELETIONS OR INTERLINEATIONS OF THIS AGREEMENT ARE PERMITTED OR WILL BE RECOGNIZED BY Kickir Club. None of Kickir Club’s employees, officers, or agents may verbally alter, modify or waive any provision of this Agreement.

 

13. Prohibited Uses

The Client shall not use Kickir Club’s website, services, accounts, or any other aspect of Kickir Club: a) to conceal or disguise the nature or origin of illicit funds or otherwise engage in conduct commonly referred to as money laundering; b) to avoid, evade, violate, or circumvent, any laws or governmental regulations, including but not limited to those laws or regulations related to anti-money laundering, counter-financing of terrorism, anti-corruption, economic sanctions, taxation, or money transmission; c) to engage in conduct detrimental to Kickir Club or that exposes Kickir Club to liability, as determined in Kickir Club’s sole discretion; d) within a restricted state or country, as set forth in paragraph 15; or e) to violate, or attempt to violate, these Terms and Conditions or any Kickir Club policy, procedure or rule. Any use described in this paragraph constitutes a “Prohibited Use,” and Kickir Club may, in its sole discretion, determine that a Prohibited Use has occurred, or is suspected to have occurred, and take any action it deems appropriate with regard to funds, property, proceeds, account or website access, use of Kickir Club services, data, or assets associated with Client’s account.

 

14. Due Diligence

Kickir Club is committed to identifying, detecting, preventing, and reporting on money laundering, sanctions violations, and other illicit activity. Accordingly, Kickir Club monitors for suspicious or illegal transactions. Kickir Club may, in its sole discretion, determine that illicit activity has occurred, or is suspected to have occurred, and take any action it deems appropriate with regard to funds, property, proceeds, account or website access, use of Kickir Club services, data, or assets associated with Client’s account.

 

15. Kickir Club currently restricts play only from the following jurisdictions:

• The United States of America and its territories.

Use of the website and associated services are expressly prohibited from the jurisdictions listed above. Any account accessed from a restricted state or country will have all access rights revoked and any balance contained in the account may be considered void. The client is required to notify Kickir Club immediately should the Client intend to relocate to, or visit, a restricted state. Client’s account will then be placed on a temporary hold or permanently closed, depending on the circumstances, with any balance available being returned to Client. Any attempt on Client’s part to circumvent these restrictions, in any way, will result in the closure of Client’s account and any balance will be deemed to have been forfeited.

IN WITNESS WHEREOF, the Client expressly agrees to the terms and conditions of this Agreement by clicking the “Create Account” button on the signup page of Kickir Club.

 

TERMS FOR UNEXPECTED EVENTS:

What happens if a match is delayed or cancelled? 

For “One Time” type of bet: 

• Before the bet starts: 

  • One of the match/s is cancelled: All funds will be returned to users.  

  • One of the match/s is postponed: The bet will stay active.

• Bet has started:

  • One of the match/s is cancelled: If a match is cancelled or suspended, the score is not effective, unless it is considered valid by the competent body.  The winners will be the ones who got right the scores of the other matches.

  • Postponed match: If a match is postponed, the bet will be active until the postponed match is played.

 

Will the penalty be considered a part of the total score for the house bet category? 

We always consider the score of the match after 90 minutes or extra time, penalties are never taken into consideration.
